Order ~ On August 8, 2012, this matter was scheduled for a trial call, with a non jury trial scheduled to start on August 13, 2012. None of the parties appeared for the scheduled trial call, but the court was able to contact Robert Woofter, attorney for Jeffrey Hardy, by telephone. The court reviewed the status of the court’s file, indicating that on April 18, 2012, the court granted an order effectively staying most of the case, although there is a claim that was not stayed because it was not part of the April 18, 2012, order. There is a claim by WF Investments on a guarantee by Jeff Hardy that was not stayed pursuant to the April 18, 2012, order. Based on the fact that the parties did not appear for the trial call, and the status of any remaining issues being unclear, the court vacates the August 13, 2012, trial date. The court requests a status update from the parties within 30 days of this order regarding WF Investments’ claim on a guarantee by Jeff Hardy, as well as any other claims the parties have not resolved. If the parties wish to have any issued tried before the court, a scheduling conference will be set. But the court advises the parties that the case will likely not get on the trial calendar before sometime next year based on the availability of the court due to the matters presently scheduled on the court’s calendar.
